These Terms of Service govern your use of officialexo.com and any purchase you make from EXO Labs. By using this site or placing an order, you agree to these terms.

1. Who we are

This site is operated by EXO Labs. References to we, us and our mean EXO Labs. References to you mean the person using the site or placing an order.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use belongs to you.

3. Products and information

We sell cosmetic products. Our products are not drugs and are not intended to diagnose, treat, cure or prevent any disease. Nothing on this site is medical advice. If you have a skin condition, are pregnant or nursing, or are using prescription topical treatments, speak to a qualified healthcare professional before use.

We take care to describe our products accurately, but we do not warrant that every description, ingredient listing, image or other content is complete, current or error free. Product photography is illustrative and colours may vary between screens.

4. Pricing and payment

Prices are shown in US dollars and may change at any time before you place an order. We reserve the right to refuse or cancel any order, including where a product has been listed at an incorrect price or where we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

5. Subscriptions

If you choose a subscription plan, you authorise us to charge your payment method on the recurring schedule shown at checkout until you cancel. Subscription pricing is the price displayed at the time of each order. You may pause, skip or cancel at any time from your account or by contacting us. Cancellation takes effect for future orders; an order already processed cannot be cancelled but may be returned under our refund policy.

6. Shipping and risk

Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery to the address you provide. You are responsible for entering a correct and complete shipping address.

7. Returns and refunds

Our money back guarantee is described on our refund policy page and forms part of these terms.

8. Acceptable use

You agree not to use this site for any unlawful purpose, not to attempt to gain unauthorised access to it, not to scrape or copy it for a competing commercial purpose, and not to submit false information or another person's payment details.

9. Intellectual property

All content on this site, including text, photography, graphics, logos and page design, is owned by EXO Labs or licensed to us, and may not be reproduced without written permission.

10. Disclaimer of warranties

To the fullest extent permitted by law, this site and our products are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall EXO Labs, its officers, employees or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of this site or any product purchased from us.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to these terms or any product shall not exceed the total amount you paid to us in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend and hold harmless EXO Labs and its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these terms, your misuse of the site, or your violation of any law or the rights of a third party.

13. Governing law and venue

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these terms or your use of this site shall be brought exclusively in the state or federal courts located in Queens County, New York, and you consent to the jurisdiction of those courts. If you are a consumer, this clause does not deprive you of the protection of mandatory consumer laws in your place of residence.

14. Changes

We may update these terms at any time. The version posted on this page is the version that applies. Continuing to use the site after a change means you accept the updated terms.
